    Abweichend von Ziffer 3.7 der AGB ist die Vertragssprache ausschließlich Englisch. Der Vertrag wird auf Grundlage der englischen AGB („Terms“) und der einbezogenen eigenen Ergänzungen von Ares Audio in englischer Sprache geschlossen. Der deutsche AGB-Ausgangstext bleibt zur Information zugänglich und hat keinen Vorrang vor der englischen Vertragsfassung. Zwingende Verbraucherrechte und die gesetzlichen Regeln zur Auslegung unklarer AGB bleiben unberührt. Diese Sprachregel beschränkt nicht unsere gesetzlichen Informationspflichten, insbesondere zum Widerruf und zum Datenschutz.

    Ares Audio supplement on the language of the contract

    Notwithstanding section 3.7 of the Terms, the sole language of the contract is English. The contract is concluded on the basis of the English Terms and the incorporated Ares Audio supplements in English. The German source text of the Terms remains available for information and does not take precedence over the English contractual version. Mandatory consumer rights and the statutory rules for interpreting unclear standard terms remain unaffected. This language provision does not limit our statutory information duties, in particular regarding withdrawal and data protection.

    Ares Audio ist die Marke für die hier angebotenen Audioprodukte von Cevahir Bayram Felix Cuma. Die Bezeichnung Cevahir Cuma Musik in den Rechtstexten bezeichnet das Geschäft desselben Inhabers; Vertragspartner bleibt Cevahir Bayram Felix Cuma.

    Ares Audio is the brand for the audio products offered here by Cevahir Bayram Felix Cuma. The name Cevahir Cuma Musik in the legal texts refers to the business of the same proprietor; your contracting party remains Cevahir Bayram Felix Cuma.

    1) Scope

    1.1 These General Terms and Conditions (hereinafter “Terms”) of Cevahir Bayram Felix Cuma, trading as “Cevahir Cuma Musik” (hereinafter “we/us”), apply to all contracts for the provision of software that you, as a consumer or business customer (hereinafter “you”), conclude with us in relation to the software products displayed in our online shop (hereinafter “Software”). We hereby object to the incorporation of your own terms unless we have agreed otherwise with you.

    1.2 You are a consumer within the meaning of these Terms if you enter into a legal transaction for purposes that are predominantly outside your trade, business or profession.

    1.3 You are a business customer within the meaning of these Terms if you are a natural or legal person or a partnership with legal capacity acting in the exercise of your trade, business or profession when entering into a legal transaction.

    2) Subject matter of the contract

    2.1 The subject matter of the contract is the provision of the Software offered by us in electronic form, together with the grant of certain rights of use as specified in more detail in these Terms.

    2.2 You do not acquire any intellectual property in the Software. The source code of the Software is not part of the Software provided.

    2.3 Installation is not part of the contract. In this regard, we refer you to the installation instructions. This also applies in particular to the hardware and software environment in which the Software is used.

    2.4 Unless otherwise stated in our product description, we do not provide you with individual application support.

    3) Conclusion of the contract

    3.1 The software products described in our online shop do not constitute binding offers on our part, but serve to enable you to submit a binding offer.

    3.2 You may submit your offer using the online order form integrated into our online shop. After placing the selected Software in the virtual shopping cart and completing the electronic ordering process, you submit a legally binding contractual offer in relation to the Software in the shopping cart by clicking the button that completes the ordering process.

    3.3 We may accept your offer within five days:

    - by sending you a written order confirmation or an order confirmation in text form (fax or email), in which case the time at which you receive the order confirmation is decisive; or
    - by making the ordered Software available to you; or
    - by requesting payment from you after you have placed your order.

    If more than one of the above alternatives occurs, the contract is concluded when the first of those alternatives occurs. The period for accepting your offer begins on the day after you send the offer and ends upon expiry of the fifth day following the sending of the offer. If we do not accept your offer within that period, this is deemed a rejection of your offer, with the result that you are no longer bound by your declaration of intent.

    3.4 If you select a payment method offered by PayPal, payment is processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”), subject to the PayPal User Agreement, available at https://www.paypal.com/de/legalhub/paypal/useragreement-full or, if you do not have a PayPal account, subject to the terms for payments without a PayPal account, available at https://www.paypal.com/de/legalhub/paypal/privacywax-full. If you pay using a payment method offered by PayPal that can be selected during the online ordering process, we hereby declare our acceptance of your offer at the time you click the button that completes the ordering process.

    3.5 If you submit an offer using our online order form, we store the contract text after the contract is concluded and send it to you in text form (e.g. email, fax or letter) after you submit your order. We do not make the contract text accessible beyond this.

    3.6 Before submitting a binding order using our online order form, you can identify possible input errors by carefully reading the information displayed on screen. Your browser's zoom function, which enlarges the information displayed on screen, can be an effective technical means of identifying input errors more easily. You can correct your entries during the electronic ordering process using the usual keyboard and mouse functions until you click the button that completes the ordering process.

    3.7 German is available to you as the language for concluding the contract.

    3.8 Orders are generally processed automatically by email. You must ensure that the email address you provide for order processing is correct so that you can receive the emails we send to that address.

    4) Right of withdrawal

    Consumers generally have a right of withdrawal. Further information about the right of withdrawal can be found in our instructions on withdrawal.

    5) Prices and payment terms

    5.1 Unless otherwise stated in our product description, the prices shown are total prices that include statutory VAT.

    5.2 For payments in countries outside the European Union, additional costs may arise in individual cases for which we are not responsible and which you must bear. These include, for example, costs charged by financial institutions for transferring money (e.g. transfer fees or currency conversion fees).

    5.3 The available payment method(s) are communicated to you in our online shop.

    6) Provision of the software

    6.1 We provide the Software by making a digital copy available to you for download over the internet. For this purpose, we send you a link by email that allows you to initiate the download of the digital copy and save it to a storage location of your choice.

    6.2 For compliance with any delivery dates, the decisive time is when the Software is made available for retrieval online and you are informed of this.

    7) Grant of rights of use

    7.1 Unless otherwise stated in our product description, we grant you a non-exclusive, perpetual, transferable right to use the Software in the agreed hardware and software environment for private and/or commercial purposes.

    7.2 You are not granted any right to modify the Software.

    7.3 Renting out our Software is not permitted.

    7.4 You are prohibited from removing and/or modifying any copy protection that may be present.

    7.5 You are entitled to make a copy of the Software for backup purposes. Copies of the Software made for proper data backup form part of its intended use.

    7.6 If you exercise your right to transfer the rights of use to a third party, you must impose your contractual obligations on that third party. Your rights of use expire upon transfer. All existing copies of the Software must be deleted.

    7.7 The grant of rights takes effect only once you have paid the remuneration owed in full.

    7.8 If you breach the agreed rights of use so seriously that we cannot reasonably be expected to continue the contract, we may terminate the agreement granting rights of use to the affected Software for cause.

    7.9 In the event of termination, you must delete all existing copies of the Software and, upon request, confirm this to us in text form.

    7.10 All other statutory and contractual provisions remain unaffected.

    8) Customer’s duties to cooperate

    8.1 You must familiarise yourself with the essential functional characteristics of the Software. You alone are responsible for setting up a functioning hardware and software environment for the Software with sufficient capacity, taking into account the additional load imposed by the Software.

    8.2 You must follow the instructions we provide for installing and operating the Software.

    8.3 We recommend that you take appropriate precautions in case the Software fails to operate correctly in whole or in part (e.g. daily data backups, fault diagnosis and regular checks of data processing results) and make a suitable backup of your data before installing the Software.

    9) Liability for defects

    If the Software is defective, the statutory provisions on liability for defects apply.

    10) Applicable law

    All legal relationships between us are governed by the law of the Federal Republic of Germany, excluding the laws on the international sale of movable goods. If you act as a consumer, this choice of law applies only insofar as it does not deprive you of the protection afforded to you by mandatory provisions of the law of the country in which you have your habitual residence.

    11) Jurisdiction

    If you act as a merchant, a legal person under public law or a special fund under public law with your registered office within the territory of the Federal Republic of Germany, our place of business is the exclusive place of jurisdiction for all disputes arising from this contract. If your registered office is outside the territory of the Federal Republic of Germany, our place of business is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to your professional or business activities. In the above cases, however, we are in any event also entitled to bring proceedings before the court at your registered office.

    12) Alternative dispute resolution

    We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

    1) Geltungsbereich
    1.1 Diese Allgemeinen Geschäftsbedingungen (nachfolgend "AGB") des Cevahir Bayram Felix Cuma, handelnd unter „Cevahir Cuma Musik“ (nachfolgend "wir/uns"), gelten für alle Verträge zur Bereitstellung von Software, die du als Verbraucher oder Unternehmer (nachfolgend „du/dich“) mit uns hinsichtlich der in unserem Online-Shop dargestellten Software-Produkte (nachfolgend „Software“) abschließt. Hiermit widersprechen wir der Einbeziehung deiner eigenen Bedingungen, es sei denn, wir haben hierzu etwas anderes mit dir vereinbart.
    1.2 Verbraucher im Sinne dieser AGB bist du, wenn du ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder deiner gewerblichen noch deiner selbständigen beruflichen Tätigkeit zugerechnet werden können.
    1.3 Unternehmer im Sinne dieser AGB bist du als natürliche oder juristische Person oder als rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung deiner gewerblichen oder selbständigen beruflichen Tätigkeit handelt.

    2) Vertragsgegenstand
    2.1 Vertragsgegenstand ist die Bereitstellung der von uns angebotenen Software in elektronischer Form unter Einräumung bestimmter, in diesen AGB genauer geregelten Nutzungsrechte.
    2.2 Du erwirbst kein geistiges Eigentum an der Software. Der Quellcode (Source Code) der Software ist nicht Teil der bereitgestellten Software.
    2.3 Die Installation ist nicht Vertragsbestandteil. Insoweit verweisen wir dich auf die Installationsanleitung. Dies gilt insbesondere auch für die Hard- und Softwareumgebung, in der die Software eingesetzt wird.
    2.4 Sofern sich aus unserer Produktbeschreibung nichts anderes ergibt, erhältst du keinen individuellen Anwendungs-Support durch uns.

    3) Vertragsschluss
    3.1 Die in unserem Online-Shop beschriebenen Software-Produkte stellen keine verbindlichen Angebote unsererseits dar, sondern dienen zur Abgabe eines verbindlichen Angebots durch dich.
    3.2 Du kannst das Angebot über das in unseren Online-Shop integrierte Online-Bestellformular abgeben. Dabei gibst du, nachdem du die ausgewählte Software in den virtuellen Warenkorb gelegt und den elektronischen Bestellprozess durchlaufen hast, durch Klicken des den Bestellvorgang abschließenden Buttons ein rechtlich verbindliches Vertragsangebot in Bezug auf die im Warenkorb enthaltene Software ab.
    3.3 Wir können dein Angebot innerhalb von fünf Tagen annehmen,
    - indem wir dir eine schriftliche Auftragsbestätigung oder eine Auftragsbestätigung in Textform (Fax oder E-Mail) übermitteln, wobei der Zugang der Auftragsbestätigung bei dir maßgeblich ist, oder
    - indem wir dir die bestellte Software bereitstellen, oder
    - indem wir dich nach Abgabe deiner Bestellung zur Zahlung auffordern.
    Liegen mehrere der vorgenannten Alternativen vor, kommt der Vertrag in dem Zeitpunkt zustande, in dem eine der vorgenannten Alternativen zuerst eintritt. Die Frist zur Annahme deines Angebots beginnt am Tag nach der Absendung des Angebots durch dich zu laufen und endet mit dem Ablauf des fünften Tages, der auf die Absendung des Angebots folgt. Nehmen wir dein Angebot innerhalb der vorgenannten Frist nicht an, so gilt dies als Ablehnung deines Angebots mit der Folge, dass du nicht mehr an deine Willenserklärung gebunden bist.
    3.4 Bei Auswahl einer von PayPal angebotenen Zahlungsart erfolgt die Zahlungsabwicklung über den Zahlungsdienstleister PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxemburg (im Folgenden: „PayPal“), unter Geltung der PayPal-Nutzungsbedingungen, einsehbar unter https://www.paypal.com/de/legalhub/paypal/useragreement-full oder – falls du nicht über ein PayPal-Konto verfügst – unter Geltung der Bedingungen für Zahlungen ohne PayPal-Konto, einsehbar unter https://www.paypal.com/de/legalhub/paypal/privacywax-full. Zahlst du mittels einer im Online-Bestellvorgang auswählbaren von PayPal angebotenen Zahlungsart, erklären wir schon jetzt die Annahme deines Angebots in dem Zeitpunkt, in dem du den Button anklickst, welcher den Bestellvorgang abschließt.
    3.5 Bei der Abgabe eines Angebots über unser Online-Bestellformular wird der Vertragstext nach dem Vertragsschluss von uns gespeichert und dir nach Absendung deiner Bestellung in Textform (z. B. E-Mail, Fax oder Brief) übermittelt. Eine darüber hinausgehende Zugänglichmachung des Vertragstextes durch uns erfolgt nicht.
    3.6 Vor verbindlicher Abgabe deiner Bestellung über unser Online-Bestellformular kannst du mögliche Eingabefehler durch aufmerksames Lesen der auf dem Bildschirm dargestellten Informationen erkennen. Ein wirksames technisches Mittel zur besseren Erkennung von Eingabefehlern kann dabei die Vergrößerungsfunktion deines Browsers sein, mit deren Hilfe die Darstellung auf dem Bildschirm vergrößert wird. Deine Eingaben kannst du im Rahmen des elektronischen Bestellprozesses so lange über die üblichen Tastatur- und Mausfunktionen korrigieren, bis du den Button anklickst, welcher den Bestellvorgang abschließt.
    3.7 Für den Vertragsschluss steht dir die deutsche Sprache zur Verfügung.
    3.8 Die Bestellabwicklung findet in der Regel automatisiert per E-Mail statt. Du hast sicherzustellen, dass die von dir zur Bestellabwicklung angegebene E-Mail-Adresse zutreffend ist, so dass du unter dieser Adresse die von uns versandten E-Mails empfangen kannst.

    4) Widerrufsrecht
    Verbrauchern steht grundsätzlich ein Widerrufsrecht zu. Nähere Informationen zum Widerrufsrecht ergeben sich aus unserer Widerrufsbelehrung.

    5) Preise und Zahlungsbedingungen
    5.1 Sofern sich aus unserer Produktbeschreibung nichts anderes ergibt, handelt es sich bei den angegebenen Preisen um Gesamtpreise, die die gesetzliche Umsatzsteuer enthalten.
    5.2 Bei Zahlungen in Ländern außerhalb der Europäischen Union können im Einzelfall weitere Kosten anfallen, die wir nicht zu vertreten haben und die von dir zu tragen sind. Hierzu zählen beispielsweise Kosten für die Geldübermittlung durch Kreditinstitute (z.B. Überweisungsgebühren, Wechselkursgebühren).
    5.3 Die Zahlungsmöglichkeit/en wird/werden dir in unserem Online-Shop mitgeteilt.

    6) Bereitstellung der Software
    6.1 Wir bewirken die Bereitstellung, indem wir dir eine digitale Kopie der Software zum Download über das Internet zur Verfügung stellen. Hierzu stellen wir dir per E-Mail einen Link zur Verfügung, über den du den Download der digitalen Kopie einleiten und die Speicherung der Kopie an einem von dir gewählten Speicherort vornehmen kannst.
    6.2 Für die Einhaltung von etwaigen Lieferterminen ist der Zeitpunkt maßgebend, in dem die Software im Netz abrufbar bereitgestellt ist und dies dir mitgeteilt wird.

    7) Einräumung von Nutzungsrechten
    7.1 Sofern sich aus unserer Produktbeschreibung nichts anderes ergibt, räumen wir dir ein nicht ausschließliches, zeitlich unbegrenztes, übertragbares Recht ein, die Software in der vereinbarten Hard- und Softwareumgebung zu privaten und/oder kommerziellen Zwecken zu nutzen.
    7.2 Ein Bearbeitungsrecht wird dir nicht eingeräumt.
    7.3 Eine Vermietung unserer Software ist nicht zulässig.
    7.4 Es ist dir verboten, ggf. vorhandenen Kopierschutz zu entfernen und/oder zu verändern.
    7.5 Du bist berechtigt, von der Software eine Kopie zu Sicherungszwecken herzustellen. Die einer ordnungsgemäßen Datensicherung dienenden Vervielfältigungen der Software sind Teil des bestimmungsgemäßen Gebrauchs.
    7.6 Machst du von deinem Recht Gebrauch, die Nutzungsrechte an einen Dritten zu übertragen, musst du deine vertraglichen Verpflichtungen dem Dritten auferlegen. Mit der Übertragung erlöschen deine Nutzungsrechte. Alle vorhandenen Kopien der Software sind zu löschen.
    7.7 Die Rechtseinräumung wird erst wirksam, wenn du die geschuldete Vergütung vollständig geleistet hast.
    7.8 Verletzt du die vereinbarten Nutzungsrechte so schwerwiegend, dass es uns nicht zumutbar ist, am Vertrag festzuhalten, können wir die Vereinbarung zur Einräumung von Nutzungsrechten an der betroffenen Software außerordentlich kündigen.
    7.9 Im Falle der Kündigung bist du verpflichtet, alle vorhandenen Kopien der Software zu löschen und uns dies auf Verlangen in Textform zu bestätigen.
    7.10 Die sonstigen gesetzlichen und vertraglichen Regelungen bleiben unberührt.

    8) Mitwirkungsobliegenheiten des Kunden
    8.1 Du hast dich über die wesentlichen Funktionsmerkmale der Software zu informieren. Die Einrichtung einer funktionsfähigen und auch unter Berücksichtigung der zusätzlichen Belastung durch die Software ausreichend dimensionierten Hard- und Softwareumgebung für die Software liegt in deiner alleinigen Verantwortung.
    8.2 Du hast die von uns für die Installation und den Betrieb der Software gegebenen Hinweise zu beachten.
    8.3 Wir empfehlen dir, angemessene Vorkehrungen zu treffen für den Fall, dass die Software ganz oder teilweise nicht ordnungsgemäß arbeitet (z.B. durch tägliche Datensicherung, Störungsdiagnose, regelmäßige Überprüfung der Datenverarbeitungsergebnisse) und vor Installation der Software eine geeignete Sicherung deiner Daten durchzuführen.

    9) Mängelhaftung
    Ist die Software mangelhaft, gelten die Vorschriften der gesetzlichen Mängelhaftung.

    10) Anwendbares Recht
    Für sämtliche Rechtsbeziehungen zwischen uns gilt das Recht der Bundesrepublik Deutschland unter Ausschluss der Gesetze über den internationalen Kauf beweglicher Waren. Wenn du als Verbraucher handelst, gilt diese Rechtswahl nur insoweit, als nicht der dir durch zwingende Bestimmungen des Rechts des Staates, in dem du deinen gewöhnlichen Aufenthalt hast, gewährte Schutz entzogen wird.

    11) Gerichtsstand
    Handelst du als Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen mit Sitz im Hoheitsgebiet der Bundesrepublik Deutschland, ist unser Geschäftssitz ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag. Hast du deinen Sitz außerhalb des Hoheitsgebiets der Bundesrepublik Deutschland, so ist unser Geschäftssitz ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag, wenn der Vertrag oder Ansprüche aus dem Vertrag deiner beruflichen oder gewerblichen Tätigkeit zugerechnet werden können. Wir sind in den vorstehenden Fällen jedoch in jedem Fall berechtigt, das Gericht an deinem Sitz anzurufen.

    12) Alternative Streitbeilegung
    Wir sind zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle weder verpflichtet noch bereit.

    Ares Audio End User Licence Agreement

    October 2026

    This is the licence agreement between you and Cevahir Bayram Felix Cuma, trading as Ares Audio, Konrad-Celtis-Str. 11, 81369 München, Germany, hello@aresaud.io ("Ares Audio").

    "Software" means the Ares Audio plug-in you obtained: the plug-in named in your licence e-mail (for example Ares DRV, Ares VRB or Ares DLY) or the free Ares EQ. Each licence covers one plug-in; a bundle is one separate licence per plug-in. "Version 1" means every release numbered 0.x or 1.x, including beta builds and the first regular release.

    This Agreement sets out how you may use the Software. It applies to licences for which you agreed to these terms when obtaining the licence, after we drew your attention to them and gave you a reasonable opportunity to read them. It does not change the terms of a licence you already hold.

    This Agreement does not set the price or the terms for payment, tax, invoices, refunds or withdrawal; those belong to your purchase. Nothing in this Agreement changes who is responsible to you under your purchase contract or under statutory law.

    This Agreement does not limit your statutory rights as a consumer.

    2. Your licence

    Ares Audio grants you a non-exclusive licence, with no expiry date, to use Version 1 of the Software.

    One licence is for one person on up to three computers, which that person may use at the same time. The computers must be your own or under your lawful control. The limit counts computers, not plug-in formats or host applications.

    You may use the Software for private and commercial work, including paid productions and client projects. What you create with it is yours; Ares Audio claims no rights in it and no royalties.

    More people need more licences. If a business acquires the licence, it designates one individual as the user. It may reassign the licence to another individual within the same business by contacting us, provided the previous user stops using it under that licence and their computers are released.

    3. Versions and updates

    Your licence covers Version 1 and every update we release for it, at no extra cost. We do not promise new features or a release schedule; updates the law requires to keep the Software in conformity are not affected. System requirements are stated on the product page.

    A later product clearly sold as a new major version (for example "Ares VRB 2") is not included. Its release does not end or reduce your licence, and you do not have to upgrade.

    4. Free licences and beta builds

    A free licence — Ares EQ, or a licence given to a beta tester — grants the same rights of use as a paid licence and does not expire when the beta ends. It does not depend on feedback, reviews or publicity and imposes no confidentiality obligation: you may talk about the Software publicly and share screenshots and audio.

    Ares EQ does not require a licence key. As an exception to the three-computer limit in section 2, you may use Ares EQ on any number of computers that are your own or under your lawful control. The rest of section 2 applies to Ares EQ as well, except that a business may reassign its Ares EQ licence without contacting us and without a computer release.

    Releases numbered 0.x are beta builds. They can contain errors, and an update can change the sound or the controls in a way that affects existing projects. This notice does not remove any right or liability that the law provides.

    5. Licence key and computers

    Every plug-in except Ares EQ is unlocked with a licence key. When you enter the key, the Software registers the computer with our licence server as soon as an internet connection is available. This sends the key and an identifier derived from the computer's hardware; our server stores that identifier only as a hash. At most three computers can be registered per licence at a time.

    When you open the plug-in window, the Software may check the licence status in the background. After a successful licence check, it waits at least 24 hours before it checks again on its own; if a check fails, opening the window again may trigger another attempt. The Software also checks for available updates. Ares EQ performs update checks but no licence checks. Without an internet connection, the Software keeps working.

    You may change computers as often as you need. To free a slot — also for a computer you no longer have — write to hello@aresaud.io. Once a computer is released, you may no longer use the Software on it under this licence, even if the installed copy still starts.

    6. Sharing, transfer and copies

    Do not share your licence key so that other people can use the Software. You may not rent out or sublicense the Software.

    You may transfer a paid licence permanently and as a whole to another person if you stop using the Software and delete your copies. Tell us the new holder's e-mail address so that we can release your computers and issue the key to them. Computer slots cannot be transferred separately. Free licences are personal and not transferable.

    You may make the backup copies you need. Your statutory rights to study the Software, correct errors and achieve interoperability are not affected. Beyond that, you may not distribute copies of the Software or bypass its licence mechanism.

    7. Ownership and third-party components

    The Software is protected by copyright and other rights of Ares Audio and its licensors. You receive a right to use it, not ownership of those rights. Third-party and open-source components remain under their own licences, which this Agreement does not restrict.

    8. Privacy

    How we process personal data for licence registration, licence checks and update checks is described in our Privacy Notice at aresaud.io/datenschutz.

    9. End of the licence

    Your licence does not end because the beta ends, a new version appears or you are offline.

    A paid licence ends if the purchase contract under which you acquired it is validly ended, for example by withdrawal or rescission. We may then deactivate the corresponding key only if doing so does not prevent you from using the Software under another licence you still hold. A price reduction, or a refund that leaves the purchase contract in place, does not end the licence. A licence you already held independently of that purchase, including a beta licence, remains unaffected.

    If a key has been published or is used by people other than the licence holder, we may block that key and will give the licence holder a replacement on request.

    When a right of use has ended, stop using the Software under it and remove copies that are no longer covered by any licence you hold.

    10. Liability, law and changes

    Ares Audio is liable in accordance with statutory law; this Agreement contains no exclusion or limitation of liability. Your statutory rights in case of defects are not affected.

    We will not reduce your rights under an existing licence by publishing a new version of this Agreement or by an update.

    German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you live.

    7. Right of withdrawal

    Für deine Käufe unserer entgeltlichen digitalen Produkte bleibt das gesetzliche Widerrufsrecht von 14 Tagen auch nach Bereitstellung, Download oder Beginn der Nutzung bestehen. Wir verlangen keine Bestätigung, dass du dadurch dein Widerrufsrecht verlierst, und machen kein vorzeitiges Erlöschen wegen der Bereitstellung oder Nutzung geltend. Der Abschnitt „Erlöschen des Widerrufsrechts“ in der nachstehenden Belehrung kommt bei diesen Käufen daher nicht zur Anwendung. Für den Fristbeginn und die Ausübung gelten die Angaben in der Belehrung; gesetzliche Verlängerungen der Widerrufsfrist bleiben unberührt.

    Nach einem wirksamen Widerruf darfst du das digitale Produkt nicht weiter nutzen oder Dritten zur Verfügung stellen. Wir können die zugehörige Lizenz deaktivieren. Das gilt unabhängig davon, über welchen zulässigen Weg du den Widerruf erklärt hast und ob die Erstattung bereits abgeschlossen ist. Du musst dafür nicht unsere Online-Widerrufsfunktion verwenden. Eine Erstattung allein bedeutet nicht automatisch, dass du den Vertrag widerrufen hast.

    Supplement by Ares Audio: withdrawal even after downloading

    For your purchases of our paid digital products, the statutory 14-day right of withdrawal remains in place even after the product has been provided, downloaded or first used. We do not require you to confirm that you thereby lose your right of withdrawal, and we do not invoke early expiry because the product has been provided or used. The section “Expiry of the right of withdrawal” in the instructions below therefore does not apply to these purchases. The information in the instructions governs when the period begins and how to exercise the right; statutory extensions of the withdrawal period remain unaffected.

    After an effective withdrawal, you must not continue to use the digital product or make it available to third parties. We may deactivate the associated licence. This applies regardless of which permitted channel you used to declare your withdrawal and whether the refund has already been completed. You do not have to use our online withdrawal function for this purpose. A refund alone does not automatically mean that you have withdrawn from the contract.

    Einleitung
    Verbrauchern steht ein Widerrufsrecht nach folgender Maßgabe zu, wobei Verbraucher jede natürliche Person ist, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können:

    A. Instructions on Withdrawal

    Introduction

    Consumers have a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside that person's trade, business or profession:

    You have the right to withdraw from this contract within fourteen days without giving any reason.

    The withdrawal period is fourteen days from the day on which the contract is concluded.

    To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

    Effects of withdrawal

    If you withdraw from this contract, we must reimburse all payments received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will make this reimbursement using the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of this reimbursement.

    Expiry of the right of withdrawal

    The right of withdrawal expires early if we have begun performance of the contract after you have expressly consented to our beginning performance before the end of the withdrawal period, you have acknowledged to us that, by giving your consent, you lose your right of withdrawal when performance of the contract begins, and we have provided you with confirmation of the contract on a durable medium setting out the content of the contract, including the above conditions for early expiry of the right of withdrawal.
